Emily Duker v. Bird Rides, Inc. RE: Notice Regarding the Disclosure of Your Contact Information to Attorneys Investigating Bird Rides, Inc.’s Business Practices
You are receiving this letter because you rented a Bird electric scooter in the State of California at some time between January 2015 to the present.
A putative class action lawsuit has been filed and is currently pending in Los Angeles Superior Court, titled Emily Duker v. Bird Rides, Inc., Case Number 19STCV01214 (the “Lawsuit”). In the Lawsuit, Ms. Duker seeks recovery for all persons who – from January 2015 to the present – rented a Bird electric scooter within the State of California. The Lawsuit seeks compensation for all Bird scooter renters who Ms. Duker claims were injured by BIRD’s unfair, unlawful, and deceptive business acts including using false advertisements regarding the safety/quality of Bird scooters. Bird disputes and denies the allegations in the Lawsuit.
As part of the Lawsuit, Ms. Duker and her attorneys are conducting an investigation for purposes of their claims. To assist in the investigation, the attorneys for Ms. Duker wish to gather information regarding your experiences using Bird scooters. Completing and submitting the opt-out form is not the same as opting out of the case altogether. If a class is certified you will still receive notice and will have an opportunity to opt out of the class, and you will not be insulated from responding to a lawfully served subpoena to be a witness at a deposition or trial.
